A BILL

To prohibit politically motivated prosecutions and investigations, and 
for other purposes.

Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``Federal Anti-Interference in 
Referrals for Justice Act'' or the ``FAIR Justice Act''.

SEC. 2. PROHIBITED PROSECUTIONS.

(a) In General.--Chapter 11 of Part I of title 18, United States 
Code, is amended by inserting after section 227 the following:
``Sec. 227A. Politically motivated prosecutions and investigations
``(a) Prohibition.--It shall be unlawful for any covered person 
knowingly to request, directly or indirectly, any officer or employee 
of the Department of Justice to conduct a criminal prosecution or other 
investigation of any particular individual, if the request is 
selectively made solely for a political purpose.
``(b) Reporting.--It shall be unlawful for any officer or employee 
of the Department of Justice knowingly to fail to report the receipt of 
any request prohibited, or reasonably believed to be prohibited, by 
subsection (a) to the Inspector General of the Department of Justice 
within 45 days of such request being made.
``(c) Penalty.--Whoever violates subsection (a) or (b) shall be 
fined under this title, imprisoned not more than 5 years, or both.
``(d) Covered Person Defined.--In this section, the term `covered 
person' means--
``(1) the President, the Vice President, any employee of 
the executive office of the President, and any employee of the 
executive office of the Vice President; and
``(2) any individual (other than the Attorney General) 
serving in a position specified in section 5312 of title 5, 
United States Code.''.
(b) Clerical Amendment.--The table of sections for chapter 11 of 
part I of title 18, United States Code, is amended by inserting after 
the item relating to section 227:

``227A. Politically motivated prosecutions.''.
