introduced the following bill; which was referred to the Committee on 
Homeland Security, and in addition to the Committees on the Judiciary, 
and Ways and Means, for a period to be subsequently determined by the 
Speaker, in each case for consideration of such provisions as fall 
within the jurisdiction of the committee concerned

A BILL

To require transparency from the Department of Homeland Security with 
respect to a certain use of force incident, and for other purposes.

Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``DHS Use of Force Transparency Act of 
2026''.

SEC. 2. PRODUCTION OF DOCUMENTS AND MATERIALS RELATING TO SPECIFIED USE 
OF FORCE INCIDENTS.

(a) Requirement To Produce Documents and Materials.--Not later than 
30 calendar days after the date of enactment of this Act, the Secretary 
of Homeland Security shall provide to the Committee on Homeland 
Security and Governmental Affairs of the Senate and the Committee on 
Oversight and Government Reform of the House of Representatives all 
documents, records, data, and materials in the possession, custody, or 
control of the Department of Homeland Security (including its 
components, offices, and subagencies) relating to the following 
incidents:
(1) Each officer or agent involved shooting of the 
Department of Homeland Security, occurring on or after January 
20, 2025, that results in a wound to or death of an individual.
(2) Any death, occurring on or after January 20, 2025, when 
in the custody of the Department of Homeland Security.
(b) Scope of Required Production.--The materials required under 
subsection (a) shall include the following:
(1) All body worn camera footage, dashboard camera footage, 
surveillance footage, unmanned aerial system footage, or any 
other video or audio recordings capturing the incidents or 
events immediately preceding or following the incidents.
(2) All written reports, including--
(A) initial incident reports;
(B) use of force reports;
(C) after action reports;
(D) supervisory reviews;
(E) internal affairs or investigative files of the 
Offices of Professional Responsibility of U.S. 
Immigration and Customs Enforcement and U.S. Customs 
and Border Protection;
(F) witness statements;
(G) officer statements;
(H) medical response reports; and
(I) communications logs, including dispatch 
records.
(3) All communications, including--
(A) emails, text messages, encrypted messaging app 
communications, or other electronic communications by 
personnel of the Department of Homeland Security 
relating to the incidents;
(B) communications between the Department of 
Homeland Security and State or local law enforcement 
agencies; and
(C) communications with Department of Homeland 
Security leadership regarding the incidents.
(4) All relevant policies and training materials, 
including--
(A) use of force policies in effect at the time of 
the incidents;
(B) training records for the involved officers and 
agents of the Department of Homeland Security; and
(C) any policy deviation reports or waivers.
(5) All photographic evidence, including crime scene 
photographs, still images extracted from video, and forensic 
documentation.
(6) All administrative or disciplinary records relating to 
the officers and agents of the Department of Homeland Security 
involved, including any actions taken as a result of the 
incidents.
(7) Any additional materials that the Department of 
Homeland Security determines to be relevant to congressional 
oversight of the incidents.
(c) Form of Production.--Materials shall be produced in unredacted 
form to the maximum extent permitted by law. If redactions are made, 
the Secretary of Homeland Security shall provide a written 
justification for each redaction, including citation to the specific 
legal authority relied upon.
