Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``HCBS Anti-Fraud Reporting Act of 2026''. SEC. 2. REQUIRING STATES TO REPORT ON ANTI-FRAUD MEASURES RELATING TO HOME AND COMMUNITY-BASED SERVICES FURNISHED UNDER THE MEDICAID PROGRAM. Section 1915(c)(2) of the Social Security Act (42 U.S.C. 1396n(c)(2)) is amended-- (1) in subparagraph (D), by striking ``and'' at the end; (2) in subparagraph (E), by striking the period and inserting ``; and''; and (3) by adding at the end the following new subparagraph: ``(F) with respect to 2026 and each subsequent year, the State will report to the Secretary on-- ``(i) any waste, fraud, or abuse detected by the State relating to services furnished under such waiver; and ``(ii) efforts taken by the State to prevent such waste, fraud, and abuse.''. <all>
