The PRO Act (H.R. 842), which Biden publicly urged Congress on March 9, 2021 to send to his desk, contained a director-and-officer liability provision allowing civil penalties for unfair labor practices to be assessed personally against executives who directed or committed violations against organizing workers. The House passed the bill on March 9, 2021, but it was referred to the Senate HELP Committee on March 11, 2021 and never received a Senate vote, so the personal-liability regime was never enacted during Biden's term.
