President Biden's July 9, 2021 Executive Order 14036 directed the FDA to work with states proposing Section 804 drug importation programs, and on January 5, 2024 the FDA authorized Florida's importation program - the first such authorization - covering certain prescription drugs from Canada. The FDA described the authorization as only 'the first step,' and the authorized program is run by a state agency rather than allowing consumers themselves to import. No consumer-level importation mechanism was in effect when Biden's term ended January 20, 2025, so the effort was formally advanced but the promised consumer importation did not land.
