The first half was acted on: on November 7, 2023 the FTC challenged more than 100 brand-name drug patents as improperly listed in the FDA's Orange Book (with additional challenges in April 2024), part of a broader Biden-era crackdown on patent-system manipulation in pharmaceuticals. The second half was not delivered: the tax deduction for prescription-drug advertising was never eliminated - the End Taxpayer Subsidies for Drug Ads Act (S.141) was referred to committee on January 28, 2021 and never advanced, and no repeal was included in the Inflation Reduction Act or any other enacted law during the 2021-2025 term. Kept in part, not in full.
