On January 20, 2021, Biden terminated the border-emergency declaration and directed that its authorities no longer be used to build a wall, halting the prior administration's construction. On October 5, 2023, however, his Department of Homeland Security determined there was an acute need to construct barriers and roads in Starr County, Texas, and waived certain laws to ensure expeditious construction, proceeding with new border-wall segments using prior-year appropriations the administration said it was legally obligated to spend. New wall was therefore constructed under his administration - an affirmative action contrary to the promise as stated - notwithstanding the initial halt and the administration's stated legal compulsion.
