Parts of this pledge were delivered. HHS codified protections for unaccompanied children in the ORR Foundational Rule (published April 30, 2024; effective July 1, 2024), implementing the Flores Settlement Agreement in regulation, and in March 2021 ICE converted its Texas family detention centers to short-term facilities holding families for under three days, with DHS also launching a small case-management pilot program in 2021. However, prolonged immigration detention was not ended for non-threatening adults, whose detention continued throughout the term, and the community-based case-management investment remained a modest pilot. Children's protections were codified and family detention curtailed, but the broader detention pledge went unfulfilled.
