Biden directed the preservation of DACA in a day-one memorandum on January 20, 2021, and DHS issued a final rule codifying the policy on August 30, 2022 (effective October 31, 2022), while the administration defended the program in court for the full term; renewals continued for existing recipients throughout. Court orders nevertheless kept DACA closed to new applicants from July 2021 onward, and on January 17, 2025 the Fifth Circuit held the codification rule unlawful while limiting relief to Texas and allowing renewals to continue. Biden personally drove reinstatement through executive action, rulemaking, and litigation, but courts prevented full restoration, so the promised certainty for Dreamers was not achieved.
