The administration ended key Trump-era policies this plan targeted: Attorney General Garland on June 16, 2021 vacated precedents that had restricted asylum for victims of domestic and gang violence, and DHS stopped placing migrants in the Migrant Protection Protocols ('Remain in Mexico') on August 8, 2022 after prevailing at the Supreme Court. However, the promised regulation clarifying protections for such victims was never finalized, and in May 2023 the administration adopted its own rule creating a rebuttable presumption of asylum ineligibility for many border crossers, narrowing access to protection.
