Congress never enacted legislation establishing a climate enforcement mechanism with milestone targets during Biden's term (Jan 2021-Jan 2025). The closest vehicle he backed, the Clean Electricity Performance Program in the Build Back Better bill, was dropped in October 2021 amid Sen. Joe Manchin's opposition, and the October 2021 framework that replaced it relied on tax credits before the bill itself collapsed in December 2021. The Inflation Reduction Act, signed August 2022, delivered major climate funding through incentives but contained no enforcement mechanism with statutory milestone targets. Biden pushed for the legislation but it did not land.
