No legislation repealing federal mandatory minimums was proposed by the White House or enacted during Biden's 2021-2025 term, including 2021-2022 when his party controlled both chambers of Congress, and no federal incentive program for states to repeal their mandatory minimums was created. The administration's engagement with sentencing came instead through executive tools - Justice Department charging guidance and clemency, including the January 17, 2025 commutations for nearly 2,500 people convicted of non-violent drug offenses - which mitigated individual sentences without repealing any mandatory minimum; even the narrower crack-powder sentencing bill died in the Senate. Reform advocates were publicly criticizing the administration's inaction on sentencing reform as early as December 2021.
