The promise had three parts, and only two were delivered during Biden's term. The 90/10 loophole was closed via the American Rescue Plan Act of 2021 with implementing regulations effective July 1, 2023, and the Financial Value Transparency and Gainful Employment rule requiring career-training programs to prove debt-to-earnings value took effect July 1, 2024. However, the promised 'return to the Obama-Biden Borrower's Defense Rule' was not achieved: the Department's 2022 replacement rule was preliminarily enjoined, and on April 8, 2024 a federal appeals court found the challengers likely to succeed and let a nationwide injunction stand, leaving the rule blocked through the rest of Biden's term while the pre-existing 2019 rule remained operative. Separate debt relief reaching 1.7 million defrauded borrowers was granted through other claims-processing authority, not through the promised rule taking effect.
