The promise had two parts, and the administration delivered one. HHS published a final rule on October 7, 2021 (86 FR 56144, effective November 8, 2021) that revoked the requirements of the 2019 Trump-era Title X regulations, restoring program eligibility for providers such as Planned Parenthood. The first part was not delivered as promised: during Biden's term CMS did not reissue the 2016 free-choice-of-provider guidance (rescinded in 2018) specifying that states cannot deny Medicaid funding to Planned Parenthood and similar providers; an August 2024 CMS informational bulletin addressed Medicaid family-planning coverage and managed-care provider choice generally, but not the promised guidance on state exclusions, which remained contested in litigation through the end of the term in January 2025.
