Biden pushed for both planks but neither landed. His FY2022 budget (May 2021) omitted the Hyde Amendment and the House passed spending bills without it, yet enacted appropriations restored Hyde every year of his term. On codification, the Senate rejected cloture on the Women's Health Protection Act (S.4132) 49-51 on May 11, 2022, with Biden publicly backing the bill; Roe v. Wade itself was then overturned in Dobbs on June 24, 2022, after which Biden issued executive orders defending access but could not restore the codified right. The promised repeal and codification were formally pursued and failed in Congress.
