Executive Order 14006 (January 26, 2021) barred the Justice Department from renewing private prison contracts, and the Bureau of Prisons ended its last private-prison contract (McRae Correctional Facility, Georgia) on November 30, 2022, fulfilling the first half of the promise. The order did not cover DHS/ICE, however, and detention of immigrants in privately operated facilities - more than 80% of ICE detainees when the order was signed - continued and expanded through the end of his term in January 2025. Because the ban was never extended to immigration detention, the promise was only partly kept.
