The promised conditioning of Byrne grants on chokehold bans never took effect. Biden backed the George Floyd Justice in Policing Act, whose Section 363 would have denied Byrne and COPS funds to jurisdictions without chokehold prohibitions; it passed the House on March 3, 2021, but bipartisan Senate negotiations collapsed in September 2021 without the bill becoming law. Biden's Executive Order 14074 (May 25, 2022) restricted chokeholds for federal law enforcement and directed agencies to use discretionary grants to encourage state and local adoption of its policies, but Byrne JAG funding was never made contingent on eliminating chokeholds.
