Trump signed Executive Order 14160 on January 20, 2025, which would have denied citizenship to U.S.-born children of mothers whose presence was lawful but temporary (including tourist visas) — the mechanism aimed at ending birth tourism. Federal courts enjoined the order before it ever took effect, and on June 30, 2026 the Supreme Court in Trump v. Barbara struck it down, holding that children born in the United States to parents unlawfully or temporarily present are citizens at birth under the Fourteenth Amendment. He issued the promised order, but it was blocked by the courts and never ended the practice — a genuine attempt that did not land.
