As of July 2, 2026, federal law does not make selling drugs, by itself, a capital offense; death sentences remain available only in narrow drug-linked circumstances such as killings connected to trafficking or a never-used large-quantity kingpin provision (18 U.S.C. 3591(b)(1)). Trump moved in the promised direction with the tools available: Executive Order 14164 (January 20, 2025) directed expansive federal pursuit of capital punishment, and Attorney General Bondi's February 5, 2025 memorandum reinstated the 2018 guidance on capital punishment in drug-related prosecutions and encouraged capital charges in trafficking-linked killings. No legislation making drug dealing per se a capital crime has been enacted or formally transmitted to Congress, and no one caught merely selling drugs has received a death sentence, so this term-2 promise has been genuinely pushed but has not landed.
