On January 29, 2025, President Trump signed Executive Order 14191 directing the Education Department to issue guidance on using federal formula funds for K-12 educational choice and to prioritize education freedom in discretionary grants; ED finalized an Expanding Education Choice grant priority effective October 9, 2025. The July 4, 2025 reconciliation law (P.L. 119-21) also created the first federal tax-credit scholarship program, a $1,700 nonrefundable credit for contributions to scholarship-granting organizations beginning January 1, 2027. Because that program is voluntary for states and not yet operative, universal school choice in every state has not been achieved, and most federal education dollars still flow through existing formulas as of July 2, 2026.
