As of July 2, 2026, the administration has not used the Comstock Act to restrict abortion medication; no Comstock prosecution or enforcement action against mailing the pills has been reported. Trump's Justice Department moved in May 2025 to dismiss a lawsuit by Missouri, Idaho and Kansas seeking to restrict mifepristone, and after the Fifth Circuit's May 1, 2026 order requiring in-person dispensing, the Supreme Court's May 14, 2026 stay kept the drug available by mail and telehealth. Mifepristone therefore remains available nationwide, consistent with the pledge, though a pending FDA safety review could still change access and the term is ongoing.
