Executive Order 14187 (January 28, 2025) directed HHS to act against gender-transition procedures for minors, expressly including Medicare and Medicaid conditions of participation, and on December 19, 2025 CMS formally proposed a Hospital Condition of Participation rule that would prohibit Medicare- and Medicaid-participating hospitals from performing such procedures on children, alongside a companion Medicaid/CHIP funding prohibition; comments closed February 17, 2026. As of July 2, 2026, however, the rules remain proposed rather than final, and no hospital has been declared out of compliance with federal health and safety standards or terminated from Medicare or Medicaid on this basis. The promised immediate declaration and termination was formally proposed through rulemaking but has not taken effect.
